1. Service Description
CDCraft (“we”, “us”, “our”) operates from
Quebec, Canada and provides a
custom media printing and engraving service. We
print custom artwork onto CD cases and engrave/burn blank CDs with
audio files provided by the customer. We do
not supply, host, download, or distribute any music
or copyrighted media.
2. User Content & Intellectual Property Rights
By placing an order, you represent and warrant that:

You own or have obtained proper authorization to
use all content (images, text, audio files) included in your
order.

Your content does not infringe on any third
party’s intellectual property rights, copyrights,
trademarks, or other proprietary rights.

You will not submit copyrighted album covers,
logos, or artwork belonging to third parties without written
permission from the rights holder.

The audio files you provide are either your
own original work, licensed for personal use, or
in the public domain.
You grant CDCraft a limited license to use your content
solely for the purpose of fulfilling your order.
3. Prohibited Content
We reserve the right to refuse or cancel any order containing:
- Copyrighted music or artwork used without authorization

Content from commercial albums, artists, or labels without proof
of licensing
- Illegal, hateful, defamatory, or sexually explicit material
- Content that violates any applicable law or regulation
4. Order Review
All orders are subject to manual review before production. We
reserve the right to reject any order at our sole discretion. If an
order is rejected, you will be notified by email and
fully refunded within 5 business days.
5. Pricing & Payment
All prices are listed in Canadian Dollars (CAD).
CDCraft currently operates under the
Canadian small supplier exemption (annual revenue
below the federal $30,000 CAD threshold), so
no GST or QST is collected on orders. The price
you see at checkout is the price you pay. Shipping fees vary by
destination and case type. Prices may change without prior notice.
Payment is due at the time of ordering and is processed securely by
Stripe; we never store your card information.
6. Shipping & Delivery
We ship to Canada and the United States only.

Production time: 2–5 business days from
payment confirmation.

Delivery time (Canada): 3–8 business days
via Canada Post.

Delivery time (USA): 5–14 business days via
Canada Post International Small Packet.

Tracking: emailed once your order ships.

Customs (USA): any duties or local taxes are the
recipient’s responsibility.
We are not responsible for delays caused by postal services,
customs, weather, or natural events. If your package is lost (no
tracking activity for 14+ days), we will open an investigation; if
unrecovered after 21 days, we will replace your order at no cost.
Incorrect addresses: providing an accurate shipping
address is your responsibility. Packages returned due to address
errors may be reshipped at your expense.
7. Refunds & Cancellations
Because each order is custom-made and has no resale value, orders
are generally non-refundable once production has
started, except in the cases below:

Cancellation before production (typically within
4 hours of payment): full refund minus non-recoverable Stripe
processing fees (about $0.30).

Manufacturing defect (faulty engraving, poor
print quality, broken case at delivery): contact us within
14 days of receipt with photos. We will provide a
free replacement or full refund at your choice.

Order rejected by us during review: full refund
within 5 business days.

Lost in transit: replacement or refund as
described above.

Damaged in transit: photograph the package
exterior and contents, contact us within 7 days; we will arrange
replacement or refund.
Orders are not refundable for buyer errors (wrong
audio file uploaded, typos in track titles, design that does not
match expectations — you preview and approve before payment,
wrong shipping address provided).
Refunds are issued to the original payment card and typically appear
within 5–10 business days. Nothing in this policy limits your
rights under the Quebec Consumer Protection Act.
8. Privacy & Personal Information
CDCraft is the controller of the personal information you provide.

Information we collect:
- Name, email address, shipping address, phone (optional)

Order content: track titles, uploaded audio files, uploaded images

Transaction identifier (Stripe PaymentIntent) for accounting; we
never store card numbers
- IP address at the time of order, for fraud prevention
Why we collect it: exclusively to process and
ship your order, communicate with you, and meet our accounting and
legal obligations. We never sell or rent your data
and we do not use it for advertising.
Third parties with whom we share data:
- Stripe (USA) — payment processing, PCI-DSS compliant
- Resend (USA) — transactional emails only
- Fly.io (Canada/USA) — secure encrypted hosting
- Canada Post or chosen carrier — for delivery

Pexels — only if you use the integrated image search; your
query is sent to Pexels
In accordance with Quebec’s Law 25, your data may be stored
outside Quebec; we ensure our partners provide an adequate level of
protection.
Retention:
- Order records: 6 years (Canadian accounting requirement)
- Uploaded files (audio, images): deleted 90 days after shipping
- Unpaid order drafts: automatically deleted after 24 hours
Your rights (Quebec Law 25): you have the right
to access, correct, request deletion (subject to legal retention),
request portability, withdraw consent, and file a complaint with
the Commission d’accès à l’information
du Québec. To exercise your rights, write to
order-cdcraft@outlook.com;
we respond within 30 days.
Cookies: we use only strictly necessary cookies
for the site’s functionality (cart, session). No advertising
or tracking cookies.
Minors: our service is not intended for persons
under 14. Minors must obtain parental consent before ordering.
9. Limitation of Liability
CDCraft is a printing and engraving service only. Our total
liability to you is limited to the amount paid for
the order in question. We are not liable for indirect damages, lost
profits, or data loss. By using our service, you agree to indemnify
and hold us harmless from any third-party claims related to
intellectual property infringement of the content you provide.
This limitation does not apply where the law does not permit it
(notably the Quebec Consumer Protection Act).
10. Force Majeure
We are not responsible for delays or non-performance caused by
events outside our reasonable control (severe weather, postal
strikes, equipment failure, pandemic, etc.). In such cases, we will
inform you and offer a postponement or refund.
11. Governing Law
These terms are governed by the laws of Quebec and Canada. Any
dispute will be subject to the exclusive jurisdiction of the courts
of Quebec. Provisions of the Quebec Consumer Protection Act remain
applicable and may not be derogated from.
12. Changes to These Terms
We may update these terms at any time. The version applicable to
your order is the one in effect at the time of payment. For
substantial changes affecting existing customers, we will notify you
by email.
